We are not Solicitors. We will arrange a consultation for you to sign the declarations with a Solicitor from our panel, or we can arrange a consultation with your own Solicitor. 

What Is an Enduring Power of Attorney (EPA)?

If you can make your own decisions & want to plan ahead, an Enduring Power of Attorney (EPA) allows you to choose someone you trust to act for you in the future if you become unable to make certain decisions yourself.

This person is called your Attorney and does not have to be a lawyer.

Co-Decision-Making Agreement

Support without surrendering control

A Co-Decision-Making Agreement allows a person to appoint someone they trust to make certain decisions jointly with them. The individual remains involved in every decision; with structured support where it is needed, decisions are made together, not on their behalf.

Decision-Making Representative Order

Court-appointed support when decisions can no longer be made

This is required where a person who has lost capacity and does not have an Enduring Power of Attorney in place.

  • A Decision-Making Representation Order is a legal arrangement made through the Court for individuals who are unable to make decisions on their own, even with support.

  • Under this arrangement, the Court appoints a trusted person, known as a Decision-Making Representative, to make decisions on behalf of the individual while always taking their wishes, preferences, values, and best interests into account.

  • Wherever possible, the Court will appoint a family member or someone the person knows and trusts. If no suitable person is available, the Court may appoint an independent representative from an approved panel.

  • The representative’s authority is limited to the specific decisions outlined in the Court Order, and the arrangement remains under ongoing Court supervision to ensure the individual’s rights and wellbeing are protected at all times.

As Solicitor involvement is required, all EPA documents are reviewed and signed by a qualified Solicitor. MELAW Solicitors facilitate Dublin based applications, while LETS Consult EPA works with a trusted network of Solicitors nationwide. Clients may nominate their own Solicitor or choose one from our panel, we will arrange a consultation for you with your local Solicitor.
