What Is an Enduring Power of Attorney (EPA)?

If you are currently able to make your own decisions but want to plan ahead, an Enduring Power of Attorney (EPA) allows you to choose someone you trust to act for you in the future if you become unable to make certain decisions yourself. This person is called your Attorney and does not have to be a lawyer.
An EPA can cover decisions about:

Co-Decision-Making Agreement

Support without surrendering control

A Co-Decision-Making Agreement allows a person to appoint someone they trust to make certain decisions jointly with them. The individual remains involved in every decision; with structured support where it is needed, decisions are made together, not on their behalf.

 

This arrangement is suitable where a person has decision-making capacity but benefits from shared support in specific areas of their life. A co-decision-maker does not need to be a solicitor and must act in line with the person’s will, preferences, and values.

  • Decisions are made jointly, with the person remaining actively involved

  • Support is provided without removing independence or control

  • Legally recognised agreement prepared in line with Irish legislation

Decision-Making Representative Order

Court-appointed support when decisions can no longer be made

A Decision-Making Representation Order applies where a person is unable to make certain decisions themselves, even with support. In these situations, the Court appoints a decision-making representative to make specific decisions on the person’s behalf.

  • Court-appointed support where no other decision-making arrangements are in place

  • Decisions limited strictly to those set out in the Court Order

  • Regular reviews to ensure the arrangement remains suitable

LETS Consult EPA works in collaboration with MELAW Solicitors, specialists in
Enduring Power of Attorney and Co-Decision Making applications. This partnership
ensures all applications are managed efficiently, professionally, and in full
compliance with Irish law.


As Solicitor involvement is required, all EPA documents are reviewed and signed by
a qualified Solicitor. MELAW Solicitors facilitate Dublin based applications, while
LETS Consult EPA works with a trusted network of Solicitors nationwide. Clients
may nominate their own Solicitor or choose one from our panel, we will arrange a
consultation for you with your local Solicitor.
