Court Appointed Support When Decisions Can No Longer Be Made
A Decision-Making Representation Order (DMR) is required where a person has lost the capacity to make certain decisions for themselves and does not have an Enduring Power of Attorney in place.
A DMR is a legal arrangement made through the Court for individuals who are unable to make decisions on their own, even with support. Under this arrangement, the Court appoints a trusted person, known as a Decision Making Representative, to make specific decisions on behalf of the individual while always taking their wishes, preferences, values, and best interests into account.
Where possible, the Court will appoint a family member or someone the person knows and trusts. If no suitable person is available, the Court may appoint an independent representative from an approved panel.
The Decision Making Representative can only make decisions that are specifically authorised by the Court Order. The Court continues to supervise the arrangement to ensure that the person's rights, dignity, and welfare remain protected.
